FreshTrack Terms of Use

These Terms of Use ("Terms") govern your use of FreshTrack ("the app"), published by Arkayen Labs ("we", "us", "our"). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. Eligibility

You must be at least 18 years old, or use the app under the supervision and consent of a parent or legal guardian, to use FreshTrack.

2. The service

FreshTrack helps you track food items and their expiry dates, receive reminders, and reduce waste. The core app works fully offline and without an account. Some features, described below, are optional and require an account or a paid subscription.

3. Accounts

An account is optional and only needed for cloud features such as backup, sync, and household sharing. You are responsible for keeping your sign-in details secure and for activity that happens under your account. You can delete your account at any time from Settings > Delete Account, or via our account deletion page.

4. Acceptable use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to break, disrupt, reverse engineer, or gain unauthorised access to the app or its systems
• Use the app to store or share unlawful content
• Interfere with another user's use of a shared pantry

5. Subscriptions and billing

Premium features (such as cloud Backup and Sync, and household sharing) may be offered as a paid subscription when available. If you subscribe:

• Payment is handled by Google Play, subject to Google Play's terms and refund policy.
• Prices, including in Indian Rupees, are shown in the app before purchase.
• Subscriptions renew according to the plan you select unless cancelled through Google Play.
• We do not receive or store your card or payment details.

Refunds are governed by Google Play's refund policy. We do not process payments directly and cannot issue refunds outside that process.

6. Food safety: important disclaimer

Read this carefully. It is the most important term in this document.

Expiry dates and product details in FreshTrack are entered by you or looked up from third-party data, and may be inaccurate, incomplete, or out of date. FreshTrack is an organisational tool only. It is not a source of food-safety, medical, or health advice, and must not be relied on to decide whether food is safe to eat, use, or serve.

You are solely responsible for judging whether any food item is safe. Always use your own judgement, inspect food, and follow official food-safety guidance. To the fullest extent permitted by law, we accept no liability for any illness, injury, loss, or damage arising from your reliance on the app, including reliance on any expiry date, reminder, or product information it shows.

7. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. We do not warrant that reminders will always be delivered, that data will always sync, or that the app will be free of defects.

8. Limitation of liability

To the fullest extent permitted by law, Arkayen Labs and its team will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the app. Where liability cannot be excluded, it is limited to the amount you paid us for the app in the twelve months before the claim, or the minimum permitted by law, whichever is greater.

9. Intellectual property

The app, its name, logo, and content (excluding your own data and third-party data such as OpenFoodFacts) are owned by Arkayen Labs and protected by law. These Terms do not grant you any right to our trademarks or branding.

10. Third-party services

The app uses third-party services including Google Firebase and OpenFoodFacts. Your use of features that rely on them is also subject to their terms. We are not responsible for third-party services.

11. Indemnification

You agree to indemnify and hold harmless Arkayen Labs from any claims, losses, or expenses arising from your misuse of the app or your breach of these Terms.

12. Termination

You may stop using the app at any time and delete your account. We may suspend or terminate access if you breach these Terms or use the app unlawfully. Data handling on account deletion is described in our Privacy Policy.

13. Governing law and disputes

These Terms are governed by the laws of India. You agree that the courts at Mumbai, India, have exclusive jurisdiction over any dispute arising from these Terms or the app, subject to any non-waivable rights you have under applicable law.

14. Changes to these Terms

We may update these Terms. We will update the date above and, for material changes, notify you in the app. Continued use after a change means you accept the updated Terms.
