1. Agreement to these terms

These Terms of Use ("Terms") govern your use of the Pamoja mobile application ("Pamoja", "the app", "we", "us", "our"), operated by Balaji Thukuntala, sole proprietor, trading as Arkayen Labs, Mumbai, Maharashtra, India.

By downloading, accessing, or using Pamoja, you agree to these Terms. If you do not agree, do not use the app.

We may update these Terms from time to time. Material changes will be notified in-app or at this page. Continuing to use Pamoja after changes take effect means you accept the revised Terms.

2. Eligibility

You must be at least 18 years old to use Pamoja.

Pamoja is not directed at children. We do not knowingly collect data from anyone under 18. If we learn that we have, we will delete the account and its data.

3. What Pamoja does

Pamoja is a social fitness accountability app. Small private groups set a shared weekly step target. Each member's step count is read from their device's health data and combined into a group total, with a leaderboard showing individual contributions.

Pamoja is provided for general wellness and motivational purposes only.

5. Your account

Pamoja requires an account. You can create one with Google, your phone number, or an email address and password. You choose which; all three give you the same account.

• Your account, and the groups and step history attached to it, follow you to a new device when you sign in again with the same method.
• Keep your sign-in method secure. You are responsible for activity that occurs through your account.
• If you sign in with a phone number, that number is how we recognise you. If you give up that number, you may lose access to your account, and we may not be able to restore it.
• Before deleting your account we will ask you to confirm your identity again, for your protection.
• You may delete your account at any time from Settings, or by contacting us at support@arkayenlabs.com. Deletion permanently removes your profile, every group membership, and your entire step history. This cannot be undone.

6. Groups, invites, and shared information

• Anyone who has your group's invite link or code can request to join that group, subject to the group's member limit. Treat invite links as private and share them only with people you intend to invite.
• An invite link stops working once a group is full, and works again if a place frees up.
• When you join a group, other members of that group can see your display name, your daily step count, your weekly step total, and your ranking. Do not join a group if you are not comfortable sharing this.
• Your age, height, and weight, if provided, are never shown to other members.
• Choose a display name and group names that are not offensive, misleading, or infringing, and that do not contain another person's personal information.

7. Acceptable use

You agree not to:

• Falsify, manipulate, or artificially generate step data by any means, including mechanical devices or software
• Use Pamoja for any unlawful, harassing, abusive, defamatory, or harmful purpose
• Attempt to access another user's account or data
• Probe, scan, reverse-engineer, decompile, or attempt to breach or circumvent the app's security, or interfere with its normal operation
• Use automated systems to access the service in a way that sends more requests than a human could reasonably produce
• Resell, sublicense, or commercially exploit the app without our written permission
• Impersonate any person or misrepresent your affiliation with anyone

We may suspend or terminate accounts that violate these Terms, without notice.

8. Privacy and your data

Your use of Pamoja is also governed by our Privacy Policy.

In summary, and without limiting that policy:

• Health and fitness data is used only to provide Pamoja's features.
• We do not sell your data, and we do not use health or fitness data for advertising.
• Health data is read from your device's health platform only with your explicit permission, which you may revoke at any time in your device settings.

9. Subscriptions and payments

Pamoja is free to use. Tracking your steps and being part of a group are free, and will stay free. We also offer an optional paid subscription, Pamoja Premium, which unlocks additional features.

Plans and price

• Premium is offered as a monthly plan and an annual plan. The annual plan works out cheaper per month.
• The price is shown in the app and on the Google Play listing before you buy, in your local currency where Google Play supports it. Prices vary by country.
• Payment is taken by Google Play, not by us. Your purchase is also subject to Google Play's own terms.

Free trial

• The annual plan may be offered with a 7-day free trial. Where a trial is offered, its length is stated in the app before you start it.
• A trial turns into a paid annual subscription automatically when it ends, unless you cancel first, and you are charged the annual price at that point.
• Cancelling during a trial keeps Premium until the trial's final day and you are not charged.

Renewal and cancellation

• Subscriptions renew automatically at the end of every billing period until you cancel.
• Cancel any time in your Google Play account settings, or through Manage subscription in Pamoja's settings.
• Cancelling stops the next renewal. It does not end the period you have already paid for, and it is not a refund. Premium stays active until that period ends.

What is free, and what Premium adds

• Step tracking, syncing and your group leaderboard are free, and stay free. So is joining groups: you can join as many as you are invited to, on any plan, forever. We will never stop you accepting an invitation.
• On the free plan you can create one group, with up to 8 members.
• Premium raises this to unlimited groups with up to 20 members each, and adds full step history, weekly recaps, charts and trends, achievements, and data export. The current list is always shown in the app.

What happens when Premium ends

• Nothing is deleted, and nobody is removed. Every group you created stays, with all of its members, even if it holds more than the free plan allows. Your step history, and your membership of other people's groups, are untouched.
• You keep viewing everything you already have. What stops is going further: creating an additional group, or adding a member beyond the free limits.
• Joining groups stays unlimited.
• Resubscribing restores full access immediately.

Changes

• We may change subscription pricing. Existing subscribers are told before any change affects them, and a price rise never applies to a period already paid for.
• What is included in free and in Premium may change over time. We will not take a feature away from you during a period you have already paid for.

Refunds

• Refunds are handled by Google Play under their refund policy, since they took the payment. We may consider a discretionary refund but are not obliged to give one.

10. Intellectual property

Pamoja, including its name, logo, design, and software, is owned by Balaji Thukuntala, sole proprietor, trading as Arkayen Labs and protected by intellectual property law. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use.

You retain ownership of the content you create (such as your display name and group names) and grant us a licence to store, display, and process it as necessary to operate the service.

11. Service availability

• Pamoja is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation.
• We may modify, suspend, or discontinue any part of the service at any time. Where reasonably possible, we will give notice before discontinuing the service entirely.
• Pamoja depends on third-party services (Google Play services, your device's health platform, cloud infrastructure, network connectivity). We are not responsible for failures caused by those services.
• Features may be unavailable on some devices or in some regions.

12. Disclaimer of warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy, reliability, or completeness of step data or any other information provided by the app.

13. Limitation of liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill.
• We are not liable for any personal injury or health consequence arising from physical activity undertaken while using Pamoja.
• Our total aggregate liability for any claim relating to Pamoja will not exceed the greater of INR 1,000 or the amount you paid us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited, including for death or personal injury caused by proven negligence, or for fraud.

14. Indemnity

You agree to indemnify and hold harmless Balaji Thukuntala, sole proprietor, trading as Arkayen Labs from any claim or demand, including reasonable legal fees, arising from your misuse of Pamoja or your breach of these Terms.

15. Termination

You may stop using Pamoja and delete your account at any time.

We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. On termination, your right to use the app ends immediately. Sections that by their nature should survive (including 4, 12, 13, 14, and 16) will survive.

16. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules.

Any dispute will be subject to the exclusive jurisdiction of the courts of Mumbai, India.

If you are a consumer, this does not deprive you of any protection under the mandatory law of your country of residence.

17. General

• Severability, if any provision is found unenforceable, the remainder stays in effect.
• No waiver, our failure to enforce a provision is not a waiver of it.
• Entire agreement, these Terms and the Privacy Policy are the entire agreement between us regarding Pamoja.
• Assignment, you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
